Transcript of birth/marriage/divorce/ death certificates registered on the territory of the United States of America

The citizen of the Republic of Moldova who registered civil status documents on the territory of the USA (children born in the USA, marriage registration, divorce, death for family members registered by the US authorities) can declare and register the civil status documents in the registry of the Republic of Moldova.
Based on the American civil status certificate and the corresponding package of documents, the authority of the Republic of Moldova will register the civil status document and issue the Moldovan certificate. Documents issued by the competent US authorities have legal force on the territory of the Republic of Moldova only if they are transcribed in the civil status registers of the Republic of Moldova. Thus, the civil status documents issued by the US authorities after August 17, 2001 are to be legalized and transcribed in the civil status registers of the Republic of Moldova, in order to obtain Moldovan civil status certificates. For this purpose, US civil status documents need to be notarially translated into Romanian and subsequently legalized (two separate legalizations are required, one for the civil status document and one for the notarized translation of the document) with an Apostille from the State Secretary of the State in which it was issued.
The registration and transcription of the civil status documents of the citizens of the Republic of Moldova, who live abroad, are carried out by the civil status offices on the territory of the Republic of Moldova or by the diplomatic missions and consular offices of the Republic of Moldova.

For the transcription of the birth certificate, the applicant will present the following in the original:

  • Application for transcription of the birth certificate (F-39CT) completed in full;
  • Birth certificate issued by the US authorities, legalized with an Apostille at the Secretary of State of the State in which it was issued;
  • The translation, authenticated by a notary, in Romanian, of the certificate, legalized with an Apostille at the Secretary of State of the State in which the notary works;
  • Valid identity documents of the parents. In the case of citizens of the Republic of Moldova - valid identity cards with the accompanying sheet or valid passports, as well as notarized copies of passports/other IDs and birth certificates, in the case of foreign citizens;
  • Parents' birth certificates ;
  • Parents' marriage certificate. If it is issued by the US authorities, it is also transcribed (the application can be submitted simultaneously);
  • A prepaid USPS envelope (priority mail or express priority mail) indicating the return address, which will contain the tracking number;

The documents are presented in original, with the exception of the documents of the foreign citizen parent, which can only be presented in copies, authenticated by a notary.

For the transcription of the marriage certificate, the applicant will present the following in original:

  • Application for transcription of the marriage certificate (F-40 CT) completed in full;
  • The marriage certificate/extract from the marriage register, which will include information about the applicants, the date and place of birth of the spouses, legalized with an Apostille at the Secretary of State of the State in which it was issued;
  • The translation, authenticated by a notary, in Romanian, of the certificate, legalized with an Apostille at the Secretary of State of the State in which the notary works;
  • Valid identity documents of the spouses. In the case of citizens of the Republic of Moldova - valid identity cards with the accompanying sheet or valid passports, as well as notarized copies of passports/other IDs and birth certificates, in the case of foreign citizens;
  • Birth certificates of spouses;
  • Previous divorce certificates of the spouses;
  • Marriage certificates issued by some states, such as Las Vegas, Texas, Georgia, etc., which only contain the names of the spouses, can be transcribed if the "application form" legalized with an apostille and its translation, also legalized with an apostille, is also presented. As a general rule, this document is issued by the office where the application for marriage was submitted. Also, if the marriage certificate does not contain the mention "name after marriage", the spouse whose name was changed following the conclusion of the marriage, will additionally attach a declaration, on his own responsibility, indicating the name he will bear after marriage;
  • A prepaid USPS envelope (priority mail or express priority mail) indicating the return address, which will contain the tracking number;
  • Confirmation of payment of consular fees;

The documents are presented in original, with the exception of the documents of the foreign citizen spouse, which can only be presented in copies, authenticated by a notary.

For the transcription of the divorce certificate or the court decisions regarding the dissolution of the marriage, the applicant will present the following in original:

  • Application for transcription of divorce certificate (F-40 CT) completed in full;
  • Moldovan marriage certificate;
  • The US divorce certificate or the final and irrevocable judgment (this fact is to be indicated in the text of the judgment) regarding the dissolution of the marriage, legalized with an Apostille at the Secretary of State of the State in which it was issued;
  • The translation, authenticated by a notary, in Romanian of the certificate or court decision, legalized with an Apostille at the Secretary of State of the State in which it was issued;
  • Valid identity documents of the spouses. In the case of citizens of the Republic of Moldova - valid identity cards with the accompanying sheet or valid passports, as well as notarized copies of passports/other IDs and birth certificates, in the case of foreign citizens;
  • Birth certificates of spouses;
  • Previous divorce certificates of the spouses;
  • If the name of the spouses after the divorce is not indicated in the divorce certificate or in the court decision, a statement signed and authenticated by the Notary will be presented, which shows the desired surname after the divorce;
  • A prepaid USPS envelope (priority mail or express priority mail) indicating the return address, which will contain the tracking number;
  • Confirmation of payment of consular fees;

The documents must be presented in original, with the exception of the documents of the foreign citizen spouse, which can only be presented in copies, authenticated by a notary.

For the transcription of the death certificate, the applicant will present the following in the original:

  • Application for transcription of death certificate (F-41 CT) completed in full;
  • US death certificate, legalized with Apostille at the Secretary of State of the State in which it was issued;
  • The translation, authenticated by a notary, into Romanian, of the certificate legalized with an Apostille at the Secretary of State of the State in which the notary works;
  • Moldovan identity card and accompanying sheet as well as ALL Moldovan passports of the deceased person;
  • Birth certificate of the deceased person;
  • The valid Moldovan identity card with its accompanying sheet and/or the applicant's Moldovan passport;
  • Confirmation of the degree of kinship (it can be the birth certificate in case the application is submitted by the children of the deceased/marriage certificate in the case of the other spouse);
  • Copy of the identity documents of the other spouse;
  • A prepaid USPS envelope (priority mail or express priority mail) indicating the return address, which will contain the tracking number;

The documents are presented in original, with the exception of the documents of the foreign citizen spouse, which can only be presented in copies, authenticated by a notary.

  • The request to transcribe the civil status document will be sent for examination to the Public Services Agency and after approval the embassy prepares the document and issues the transcribed Moldovan certificate. In some cases, the certificate can be issued directly by the civil status office;
  • The request for the transcript and issuance of the certificate cannot be expedited. Once initiated, the process must be completed, for which reason it is recommended that the person who plans to travel to the Republic of Moldova during this term, transcribe the act in the Republic of Moldova at the territorial civil status service;
  • US documents submitted for this purpose are archived by the Moldovan authorities and are not returned to the applicant;
  • In cases of submitting the application to the civil status office in Moldova in person or by proxy, the deadline for obtaining the certificate is reduced. The power of attorney can be authenticated at the Embassy. For additional information, we recommend checking the notarial documents section.
  • Applications for the transcription of the marriage certificate and the transcription of the child's birth certificate can be submitted simultaneously.
  • All requests, which meet the general conditions, are sent to the Public Services Agency, which examines the request and either approves the issuance of the certificate by the embassy or issues the document.
  • The embassy sends the appropriate certificate or notification to the home address of the person indicated on the envelope, via USPS courier. If he did not request home delivery, the consulate informs the applicant by email or phone about the possibility of picking up the certificate, personally or by the person authorized by power of attorney.
