Citizens of the Republic of Moldova who live permanently on the territory of the USA and have obtained a permanent residence permit in the USA can apply for authorization for this purpose to leave the Republic of Moldova to live permanently in the USA and obtain the status of a non-resident citizen of the Republic of Moldova. Obtaining authorization to leave for permanent residence in the USA does not affect the person's citizenship or the rights of a citizen of the Republic of Moldova. After the approval of authorized emigration from the Republic of Moldova, the identity card is withdrawn and cancelled. Also, the address of residence in the Republic of Moldova will be deleted, including the state of residence on the territory of the USA.

Citizens, who leave the Republic of Moldova to establish their domicile abroad, have the right to take on their own account the assets belonging to them and their family members, legally obtained currency, to maintain ownership of the assets located on the territory Republic of Moldova as well as the money and other properties, which are in the financial institutions of the Republic of Moldova. Crossing the State border with art objects and other valuables will be done according to the regulations of the legislation of the Republic of Moldova.

For the examination of the application for authorized emigration, the applicant will present:

  • All valid or expired passports, (If the applicant does not have a valid passport, the application for its issuance is submitted simultaneously with the application for the issuance of the emigration authorization, provided that the deadline for ordering the passport issuance service does not exceed the deadline for ordering the emigration authorization service); 
  • The Moldovan identity card with the accompanying sheet;
  • Driver's license, green card, US passport;
  • Four photos, matte, color, on a white background, 2 x 2 inches;
  • Civil status documents (the birth, marriage, divorce certificate, the extract from the marriage certificate, which confirms the registration of the marriage or the dissolution of the marriage in the case of persons who dissolved the marriage abroad. If the authorities of the corresponding state do not issue divorce certificates, it is necessary to present the certificate or the notice regarding the annulment, modification, rectification or completion of the civil status act), as appropriate, if necessary. The presentation of civil status documents is NOT mandatory if there have been no changes in the civil status and in the personal data since the issuance of the last identity document of the citizen of the Republic of Moldova; In the case of minor children, the notarized declaration of the parent, who remains domiciled or residing in the Republic of Moldova together with the child, which will indicate his consent for the emigration of the other spouse;
  • Proof of tax payment.

In the case of emigration with minor children, additionally:

  • The child's birth certificate;
  • Patru fotografii, mat, color, pe fon alb 2 x 2 inch;
  • Four photos, matte, color, on a white background, 2 x 2 inches;
  • Notification regarding the cancellation, modification, rectification and/or completion of the civil status document - in the event that there have been changes, corrections or additions to the child's personal data since birth;
  • The child's identity card, if his age is over 16 or if he was previously documented with an identity card;
  • In the case of changes to the personal data of the child aged 16 and over and holding Moldovan civil status certificates regarding the change, the submission of the application for authorized emigration can only be made simultaneously with the request for the provisional identity card with updated personal data.
  • Parents' marriage/divorce certificate;
  • Valid Moldovan identity document of the parent;
  • The final and irrevocable court decision regarding the forfeiture of parental rights (in case one of the minor's parents is deprived of parental rights);
  • Declarația autentificată de notar a copilului cu vârsta peste 14 ani, care își stabilește domiciliul în străinătate împreună cu unul dintre părinți, privind acordul la emigrare cu părintele respectiv;
  • In order to establish the child's domicile abroad, the consent expressed by declaration of both parents whose signatures are legalized by a notary is required;
  • Declaration authenticated by a notary of the parent who remains domiciled or resident in the Republic of Moldova regarding his agreement for the child's emigration with the other parent or the agreement for the emigration of the child to the other parent who is already settled abroad. In the latter situation, the parent's statement will be presented, which will include that they grant the living space and ensure the maintenance of the child;
  • Declaration of the child over the age of 14, authenticated by a notary, regarding his consent to emigration and the establishment of domicile abroad with the respective parent;
  • In case the applicant cannot obtain the specified statements for certain reasons, he will present the final and irrevocable court decision regarding the right to emigrate without the respective agreements;
  • Proof of tax payment.

All documents must be presented in original.

If the notarial documents are issued by US notaries, they must be translated into Romanian, with the apostille applied to both documents. The apostille is applied by the Secretary of State where the notary / translator works.
